Data Protection and Data Management Information for customers using the services of WinOffice Kft.

 

REGULATION 2016/679 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL (EU) on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Regulation (EC) No 95/46 (General Data Protection Regulation). 27 April 2011) – hereinafter referred to as GDPR – and Article CXII of 2011 on the right to information self-determination and freedom of information. law – hereinafter referred to as Info. TV. – Based on the provisions of Section 16, WinOffice Kft. informs its customers using its services about the personal data managed by it, the operations performed with the personal data and the practice of their processing as follows.  

 

 

1. General information.

 

WinOffice Kft. as the operator of the Spotjuke.com website, continuously incorporating into its work processes during its activities, guarantees that the personal data of its customers and prospective customers are collected and stored only for the purpose specified by law, and at the same time ensure the enforcement of data subjects’ rights.  

This information contains a description of the data processing operations performed on your personal data, grouped according to our services, together with a description of the data processing legislation and the planned duration of data processing, for each service. 

We provide for the rights you have during data management and the possibility of enforcing them, given that they can be enforced in the same way for all the services we provide, in a separate chapter of the Prospectus. 

When you contact us, such as requesting an offer for our services or using one of our services, we will process the personal information you provide in order to contact us in accordance with the contents of this information and store it for a specified period of time.

By data management, we mean the processing of your personal data between you – as a data subject – and WinOffice Kft. – as a data controller – due to the use of WinOffice Kft.’s services or in connection with other reasons. 

We need your personal data in order to perform other tasks related to the performance of the contract concluded between us or the contract concluded between us and specified by law, such as the provision of data. In this case, we are obliged to process your personal data in accordance with the regulations contained in various legal regulations, so the duration of the data processing and the scope of the processed data are not determined by our company.

4. Data management grouped by service:

 

4.1. For customers using content services: 

 

4.1.1. Persons involved in data management: customers using the content service.

4.1.4. Legal basis for data management: 

Pursuant to Article 6 (1) (b) of the GDPR, in the case of performance of a contract related to a service, data processing is lawful if it is necessary for the conclusion or performance of a contract between the data subject and the data controller. 

Relevant regulations: 

Pursuant to Section 169 (2) of Act C of 2000 on Accounting (Accounting Act), the accounting document supporting the accounting accounts directly and indirectly must be kept in a legible form for at least 8 years, in a retrievable manner on the basis of the reference to the accounting records.

4.1.6. Duration of data management 

In case of using the service, 8 years from the issuance of the invoice in accordance with the provisions of Section 169 (2) of Act C of 2000 on Accounting (Accounting Act),

The processing time for CVs and other documents sent voluntarily is two years. 

 

 

5. Data transmission

 

WinOffice Kft. Transmits the data of the data subjects managed by it only in the cases specified in the legislation and to the authorities entitled to do so, in order to manage the case of the data subject. 

 

 

6. Use of data processors

 

WinOffice Kft. does not use a data processor in relation to the personal data it manages. 

 

 

7. Method of data management

 

WinOffice Kft. Records and stores the personal data of its customers primarily electronically, with the help of IT tools. Printed documents – invoices, contracts, quotes, etc. – in the case of – the data processing is carried out with the involvement of own employees, while ensuring the protection of personal data. 

Together, the controls built into the workflows and the records and case management rules in place ensure that stored personal data cannot be accessed, destroyed or enforced by data subjects throughout the data processing process. 

 

 

8. Rights of data subjects

 

Irrespective of the legal basis for the processing of the data subject’s data, they have the right to request information about their personal data at any time during the processing of their personal data. They may request the correction, correction, modification or restriction of the processing of erroneous data, they may request the blocking of their data, their deletion or their transfer to another data controller.

The right to data portability

You have the right to receive your personal data from the operator in a machine-readable form, to make them available to third parties, or to request the direct transfer of the data to third parties. 

 

Right to protest

If the data processing is necessary for the enforcement of the legitimate interests of the data controller or a third party, or in the public interest or in the exercise of a public authority conferred on the data controller, you have the right to object to the processing of your data. In this case, the data controller may only further process his / her data if he / she proves that the processing of his / her data is justified by reasons that take precedence over the interests, rights and freedoms of the data subject. 
If your personal data is processed for the purpose of direct business acquisition, you may at any time object to the processing of that data for that purpose. In this case, your data cannot be further processed for this purpose. The above also applies to profiling. 

 

Automated decision making in individual cases, including profiling

The data subject shall have the right not to be covered by a decision based solely on automated data processing, including profiling, which would have legal effects on him or her or would be similarly significant. The foregoing shall not apply where this is done for the purpose of concluding a contract between the data subject and the data controller, or as a result of a legal provision which lays down rules for the protection of the data subject but also for the data subject, or is based on the data subject’s express consent.

9. Remedies
